Foreign Subsidies Regulation

The Directorate-General for Internal Market, Industry, Entrepreneurship and SMEs (DG GROW) is responsible for enforcing the Foreign Subsidies Regulation in foreign financial contributions to public procurement procedures. It also has the power to launch ex officio procedures to tackle the distortive effects of foreign subsidies in public procurement.

The Directorate-General for Competition (DG COMP) is responsible for enforcing the Foreign Subsidies Regulation in foreign financial contributions to concentrations and has the power to launch ex officio procedures.

The procedures conducted by DG COMP and DG GROW are distinct, therefore please make sure to address submissions to the relevant Directorate-General of the Commission.

Send notifications and declarations

1. Economic operators

  • Fill out the notification and declaration forms

Notifying parties are invited to use the online FS-PP form (this requires EU-Login, see EU-Login tutorial) provided by the Commission, to create the submission taking the form of a FS-PP pdf file.

  • Communicate with the Commission

To ensure secured communication, the Commission recommends economic operators to use EU Send.

To use it, economic operators are invited to send their EU-Login or email used to create the EU-Login to grow-fsr-pp-notificationsatec [dot] europa [dot] eu (grow-fsr-pp-notifications[at]ec[dot]europa[dot]eu) (to create an EU-Login, see EU-Login tutorial).

Once received, DG GROW will create a communication channel with the economic operator in EU Send to ensure secured communication.

Please note that an existing channel for EU-Send with DG COMP cannot be used for exchanges with DG GROW.

2. Contracting authorities

  • Forward notifications and declarations received from economic operators with tender

Contracting authorities are invited to forward notifications and declarations received from economic operators via EU Send.

To use it, please first send your EU-Login or email used to create the EU-Login to grow-fsr-pp-notificationsatec [dot] europa [dot] eu (grow-fsr-pp-notifications[at]ec[dot]europa[dot]eu) (to create an EU-Login, see EU-Login tutorial).

Once received, DG GROW will create a communication channel with the economic operator in EU Send to ensure secured communication.

Please note that an existing channel for EU-Send with DG COMP cannot be used for exchanges with DG GROW.

  • Communicate with the Commission

Secured exchanges – including the sending of acknowledgement of receipts – between the Commission and contracting authorities can only be ensured by EU Send.

Why use EU Send?

EU Send provides a safe and secure communication channel with the Commission to ensure the maximum level of confidentiality.

Secure communication is particularly important to safeguard competition and business secrets, in particular relating to: acknowledgement of receipt, request for information, request for waiver and any other communication containing confidential information.

While the use of EU Send is not mandatory, the Commission cannot guarantee confidentiality through non-secured email communications. For this reason, upon receipt of the notification/declaration, the Commission will not send the acknowledgement of receipt within the first 48 hours, unless the EU-login is provided. If within the first 48 hours, the Commission does not receive the EU-login of the economic operators concerned, it will proceed with sending the acknowledgement of receipt by email, including a last invitation to sign up for EU Send.
